TERMS AND CONDITIONS

By submitting your work at www.abandonednovel.com, or via any other Alternate Submission Method, you agree to the following Terms and Conditions. Do not submit your work if you do not agree to these Terms and Conditions:

1. As used herein, “you” refers to the person submitting the work for consideration. “Us” means Teton River Productions, Inc., a Montana corporation. “The work” or “your work” refers to the written product you submit to us for consideration. “Agreement” means these Terms and Conditions.

2. You understand that we will review the work and that such review involves an expenditure of time and resources by us. You agree and acknowledge that such a review constitutes sufficient consideration to support the enforceability of these Terms and Conditions.

3. You warrant and covenant that you are the sole author and owner of the work you submit to us. You further warrant and covenant that no other person or entity has any vested or contingent interest in the work, including, without limitation, assignments of copyright, licenses or options applicable to the work. You further warrant and covenant that you are the sole owner of the copyright to the work.

4. You agree that by submitting the work to us, you grant us a three year option to enter into an agreement with you to publish the work. During that time, you will not submit the work to any other publisher, nor will you self-publish or display the work in any public forum.

5. You understand and agree that our receipt and review of the work does not constitute an agreement by us to publish the work. If the work is accepted for publication, you will be notified by us, and you will receive a separate contract for publication. You further understand and agree that if you fail to return an executed contract by the date stated in your notification, the offer of publication expires and is null and void.

6. By submitting the work to us, you also grant us a license to publish all or part of the work online at abandonednovel.com provided that (a) we display your copyright notice and (b) the work shall not be available on the website for more than 30 days.

7. You agree that other than these terms and conditions, there are no other agreements or representations between us and you relating to the work. You should not rely upon any agreement or representation not contained in these Terms and Conditions.

8. You agree that these Terms and Conditions are governed by the law of the State of Montana, and that any action for enforcement of these Terms and Conditions must be brought in state court in Teton County, Montana.

9. You agree that these Terms and Conditions may be modified only in a writing signed by us. We may also alter the Terms and Conditions by posting new Terms and Conditions on www.abandonednovel.com/terms.html Any such modifications will apply retroactively unless you give notice to us within 20 days of the posting of the Terms and Conditions that you wish to withdraw the work from consideration. Upon receipt of such notice, we may, within 14 days, retain the rights to the work under the Terms and Conditions as they existed at the time the work was submitted, by notifying you of the same.

10. You agree to indemnify, defend and hold us harmless against any suits, claims or damages brought or assessed against us as a result of your breach of any warranty or covenant in this Agreement.

11. All notices to you may be given by e-mail, fax or U.S. mail. All notices to us shall be given by certified mail, addressed to Kyle M. Jones, Arnold & Placek, P.C., 203 E. Main, Ste. 201, Round Rock, Texas 78664.
